1. Scope

These General Terms and Conditions (AGB) apply to all bookings and stays at the Forty + One Hotel, operated by BOSU SBS Hotel GmbH, FN 631693 k, Schönbrunner Straße 41, 1050 Vienna, Austria (hereinafter “Hotel”), managed by Dwell Bell.

By confirming a booking through our website (fortyplusone.at), a booking platform (e.g. Booking.com), or in person, the guest agrees to these Terms and Conditions.

Where bookings are made via third-party platforms, the respective platform’s terms may also apply. In case of conflict, the conditions stated in the specific booking confirmation shall prevail.

2. Booking Details

All details regarding room type, services, breakfast, prices, and cancellation conditions are stated in the individual booking confirmation, the booking platform listing, or the official hotel website. The conditions valid at the time of booking are binding.

3. Rates and Cancellation Policy

Both rate types available with or without breakfast. Cancellation terms remain the same.
A non-refundable administrative fee of €100 applies to all cancellations.
Different policies may apply for bookings via third-party platforms.
The Hotel reserves the right to update rates. The version valid at booking time is binding.

4. Payment Methods

Online payments processed via MEWS Payments (Adyen).
On-site: self-check-in terminal or reception desk (07:00–23:00).
Accepted: credit/debit cards. Cash may be accepted at reception.

5. Check-in and Check-out

5.1 Check-in Options

Online check-in: Complete in advance, collect room card at the terminal.
Self-check-in: Full check-in directly at the terminal.
Personal check-in: At reception 07:00–23:00.
After hours: Night entrance + self-check-in terminal.

6. Hotel Access

Main entrance: Open daily 08:00–23:00.
Night entrance: Right of main entrance. Access via room card or bank card.
Bank card: Used solely for identity verification. No card data is stored or processed.

7. Parking

The hotel does not have private on-site parking. Partner parking is available nearby. By completing a booking, guests accept this arrangement.

8. Included Services

Included in the room rate:

Bed linen and towels
Wi-Fi and TV
Daily housekeeping
Electricity, water, heating
Basic toiletries (soap, shampoo, shower gel)

Breakfast: Available as an add-on depending on the selected rate.

9. Minibar

Guests must report consumed minibar items before check-out. Payment via guest portal or credit card charge.

10. Damages and Liability

Guests are responsible for any damage to furnishings, inventory, or building during their stay. The Hotel reserves the right to charge costs to the guest’s credit card after departure.

Hotel’s liability: The Hotel shall not be liable for loss, theft, or damage to personal belongings, except where liability arises from intent or gross negligence, or where mandatory Austrian law (KSchG, ABGB §§ 970, 970a innkeeper liability) provides otherwise.

11. House Rules and Common Areas

Shared areas must be used respectfully.
Smoking: Strictly prohibited in all indoor areas.
Quiet hours: 22:00–07:00.
Breakfast and facility areas: posted operating hours only.

11.1 Sauna and Fitness Area

Use at guest’s own risk.
Sauna available daily until 10:00 AM only.
On-site usage rules apply.

12. Pets, Additional Guests and Special Requests

Pets: Only with prior written approval; additional charges may apply.
Pets must not be left unattended in rooms or common areas.
Additional guests beyond booking capacity not permitted without arrangement.

13. Right of Entry

Hotel personnel may enter guest rooms for:

Technical maintenance
Cleaning and housekeeping
Emergency situations
Justified suspicion of damage or rule violations

In non-emergency situations, prior notice will be provided where possible.

14. Technical Equipment

All equipment (Wi-Fi, lighting, TV, climate control) must be used correctly. Damage from misuse will be charged to the guest.

15. Data Protection

Personal data is processed per GDPR and the Austrian DSG. Bank cards used for night entrance identification are not stored. Full details: https://fortyplusone.at/privacy-policy/

16. Guest Registration

Under Austrian law (Meldegesetz), we must collect personal data from all guests and register them with the municipal authority. After booking confirmation, you will receive a link to provide your details digitally. This is a legal obligation.

17. Governing Law and Jurisdiction

Austrian law applies exclusively. Jurisdiction: competent courts of Vienna, except where mandatory consumer protection (§14 KSchG) requires otherwise. Contract language: German. In case of discrepancy, the German version prevails.

18. Severability

If any provision is held invalid, the remaining provisions remain in effect. The invalid provision shall be replaced by a valid one reflecting the original intent.

19. Acceptance of Terms
